Subject: The Court, in the matter of retroactivity of civil law, has deemed groundless the question of constitutional legitimacy of the interpretative norm provided by art. 1, paragraph 218, of the law of 23 December 2005, n. 266, concerning the juridical treatment of state employees and enforceable to trials in progress, because it is not in contrast with the concept of fair trial provided by article 6 of the ECHR, as interpreted by the Court of Strasbourg.
