Subject: According to the Court, national legislation that imposes less favourable treatment for persons whose professional experience has, albeit only in part, been acquired before the age of 18 as compared with those who have acquired experience of the same nature and of comparable length after attaining that age, establishes a difference in treatment between persons based on the age that is not adequate. The two aims pursued by the national legislation, on the one hand the aim to encourage pupils to pursue a general secondary education rather than vocational education, on the other hand the aim to promote the recruitment of persons who have had a vocational education rather than of persons with a general education, are legitimate, but contradictory.
